Murielle Asser

Murielle Asser has a post-graduate degree (DESS) in International Law from the University of Paris V- René Descartes and was called to the Bar in 1999.

Before creating her own Firm, Murielle Asser had 14 years’ experience as an associate with leading law firms: Orrick Rambaud Martel, BCTG & Associés, Bird & Bird Paris and Jeantet.

She also had a number of internships abroad with major law firms in Spain and the United Kingdom, which included Uria & Menendez in Madrid, Spain, Salans Hertzfeld Heilbronn HRK in London, England, and Brodies LLP in Scotland.

Murielle Asser has written several articles for specialist reviews (Jurisprudence Sociale Lamy, Revue Bleue (FNAIM) etc.) and is a regular participant in social law conferences.

She is involved in training programmes and has more particularly taught at the Paris Ecole des Mines, and assists with the setting up and leading of digital law workshops.

She is a member of AVOSIAL (Association for social law lawyers).

Our lawyers deal with both consulting and litigation for French clients requiring assistance in various areas of social law, and for “anglo-saxon” or international clients seeking assistance with managing the social law aspects of their French establishments.

FEES

Our fees are set in line with ethical rules and take account of time spent. An hourly rate is applied, or a previously agreed lump sum, together with additional fees depending on the outcome (in this case, a lump sum minimum is agreed, at the beginning, as success fees only are prohibited in France.)

Decreasing hourly rates may be offered to institutional clients, depending on the time spent each month for the client, or the volume of work entrusted to us.

We work hand-in-hand with in-house legal and human resources departments, and provide consulting and/or litigation assistance to our clients in all areas of social law

Consulting

  • Individual employment relations: the drafting of employment contracts and sensitive clauses, disciplinary procedures, termination of employment contracts, assistance with the negotiation and drafting of settlement agreements, employee secondment and expatriation, executive compensation.
  • Collective employment relations: the organisation of elections to employee representation bodies, the operating of these bodies (employee representatives, Works Council, Health and Safety/Working Conditions Committee etc.), company agreements, internal regulations, ethics policy, internet policy.
  • Status of managerial or top executives and executive officers: assistance within the negotiations for their arrival/or departure from the Company.
  • Due diligence and social support at the time of mergers and acquisitions, restructuring operations, transfer of business and registered office. The Firm has specific expertise in this area and is able to provide assistance:

         ○in identifying the social consequences of these operations (informing and consulting employee representatives, job protection plans, outsourcing).

         ○in conducting detailed social audits and analysing the impact on collective status.

  • URSSAF inspections

Litigation

We assist our clients with strategic litigation before the civil, criminal and employment courts, whether concerning individual or collective disputes, including:

  • Individual disputes.
  • Collective disputes relating to redundancies.
  • Management of disputes with the Works Council or other employee representation bodies.
  • Criminal employment law, obstruction of the law, action against company executives, etc.
  • Assistance before the Social Security court (URSSAF / Industrial accidents / Occupational health / employer negligence).

International

MULTINATIONALS

We act for multinationals or conglomerates of various nationalities. We have acknowledged expertise in social law issues with an international dimension.

ESTABLISHMENTS

We assist companies and international groups with their restructuring operations or international or European establishment projects which have an impact in France.

We provide assistance to international clients concerning the transfer of businesses and employees, expatriation, impatriation or employee secondments, together with the management of European-level employee representation bodies.
